These Terms of Service (“Terms”) govern your access to and use of the KingsPay mobile application and related services. By creating an account or using KingsPay, you agree to these Terms.
1. Eligibility
- You must be at least 18 years old to use KingsPay.
- You must be a resident of Nigeria with a valid phone number and email address.
- You must not be on any sanctions or restricted persons lists.
- By using KingsPay, you represent that all information you provide is accurate and complete.
2. Account Registration & Security
- You are responsible for maintaining the confidentiality of your account credentials, including your password and transaction PIN.
- You must enable biometric authentication if your device supports it to enhance security.
- You agree to notify us immediately of any unauthorized use of your account.
- We may suspend or terminate your account if we suspect unauthorized access or fraudulent activity.
- You are responsible for all transactions initiated from your account, whether authorized by you or not.
3. KYC & Identity Verification
- KingsPay is required by Nigerian financial regulations to verify the identity of all users.
- You agree to provide accurate identity documents and information for KYC verification.
- Failure to complete KYC verification may result in restricted account functionality and lower transaction limits.
- We reserve the right to request additional verification documents at any time.
4. Transactions & Fees
- All transactions are subject to verification and applicable fees, which will be displayed before confirmation.
- KingsPay reserves the right to reverse or cancel transactions in case of errors, suspected fraud, or regulatory requirements.
- Virtual card creation is subject to a one-time issuance fee (currently NGN 2,000), displayed before confirmation.
- Gift card rates displayed are subject to change based on market conditions.
- Cryptocurrency transactions are subject to network confirmation times and applicable network fees.
5. Prohibited Activities
You may not use KingsPay for:
- Any illegal activity, money laundering, terrorist financing, or fraud.
- Violating any Nigerian laws or regulations, including CBN guidelines.
- Attempting to bypass security measures, tamper with the app, or access other users’ accounts.
- Using automated scripts, bots, or scrapers to interact with the platform.
- Misrepresenting your identity or providing false information.
6. Limitation of Liability
- KingsPay is provided on an “as is” basis. We strive for 99.9% uptime but do not guarantee uninterrupted service.
- We are not liable for losses arising from unauthorized account access due to your negligence (e.g., sharing your PIN).
- We are not liable for service interruptions caused by third-party providers (bank networks, mobile networks, crypto networks).
- Our total liability is limited to the amount of fees you paid us in the 12 months preceding the claim.
7. Termination
- You may close your account at any time by contacting support.
- We may suspend or terminate your account for violating these Terms or applicable laws.
- Upon termination, you must withdraw any remaining balance. Outstanding virtual cards must be depleted before account closure.
8. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of KingsPay after changes constitutes acceptance of the new Terms.
9. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved through amicable negotiation, and if unresolved, through the courts of Nigeria.
